It is important to realize that a DUI arrest commences 2 separate actions: the criminal case in court, and the administrative action against your license.
After your arrest, the officer is required to notify the department of licensing if you refused the breath test or you have a test result over the limit.
This opens an administrative action against your license and DOL will send you a letter noting the date you must stop driving.
The officer is also required to give you notice that you have a right to a hearing to challenge the administrative action, typically done after the DUI arrest process is done.
Timing is critical. If you do not act immediately to request a hearing with the Department of Licensing within 7 days of receiving notice of your right to a hearing, your license will automatically be suspended or revoked.
Typically this action takes effect 30 days after your arrest, but if you had a blood draw, it may or may not be later than 60 days.

The Case in Criminal Court is Completely Separate from the DOL Matter

If this is the first time you have been arrested for a DUI, you might not be familiar with the penalties that are involved. We work hard to avoid these penalties for our clients by either getting the charge reduced to something that is a non-DUI, such as a reckless driving, or in rare cases, we may even get the case completely dismissed.
For a first DUI conviction the penalties include:
- A minimum of 1 day in jail, maximum of 364 days
- A minimum fine of just under a thousand dollars, plus probation fees
- License suspension for at least 90 days; 1 year if you refused the breath test
- Probation
- SR-22 insurance for 3 years
- Ignition interlock device on any vehicle you drive at your expense for at least a year
- Chemical dependency assessment and court-mandated treatment if recommended
There are other non-legal ramifications that may occur as a result of a DUI conviction.
If your occupation requires a clean driving record, you may lose your job and have difficulty finding future employment.
A DUI or Physical Control conviction will never be vacated or expunged, it will follow you for the rest of your life.
Background checks by prospective employers, lenders, landlords, colleges and universities and other entities important to your life and your future will see the conviction.
